Man arrested for sodomising brother

POLICE in Plumtree have arrested a 35-year-old Zimbabwean based in Botswana for allegedly sodomising his 15-year-old cousin brother twice.

Christopher Phuthi of Mphoengs area in Mangwe yesterday appeared before Plumtree magistrate, Gideon Ruvetsa. The prosecutor, Paul Mpofu told the court how the first incident allegedly occurred on December 7 in Mphoengs area. He narrated how Phuthi locked the door and ordered the complainant to lie on the bed facing down.

The complainant refused and Phuthi took his belt and threatened to beat up his cousin brother if he did not comply. The juvenile gave in and the accused person had backside sex with him without his consent.

On another day, the complainant was playing with his friend when his cousin brother asked the complainant to accompany him home. On their way they met the complainant’s sister who was on her way to the business centre.

The complainant left his cousin brother in the company of his sister and proceeded home to take a bath but he was later pursued by the accused person who raped him while he was dressing in his bedroom.

In his statement in court the juvenile complainant said: "I tried to struggle with my brother but he overpowered me and I could not stop him.

At first I was screaming but no one could hear me as I was alone in the house. He later covered my mouth with his hand in order to stop me from screaming.

"He then forcibly had an*l sex with me. I felt a lot of pain but I could not stop him. He told me that the incident was supposed to remain our secret as he had done it for my benefit but I later told my older brother," said the juvenile.

Phuthi denied the allegations.

He said that he was only at the homestead to collect money from the complainant’s sister but he found her absent and then left for his home. Phuthi was remanded in custody to January 13.
