Man fatally stabs uncle for flirting with his girlfriend

Justice Lawrence Kamocha sent Jaconia Moyo away for 25 years after he admitted stabbing his uncle to death for flirting with his girlfriend.
Moyo, 18, was spared the death sentence by a High Court judge - because of his age.
"You escaped the capital sentence because of your youthfulness," Justice Kamocha told Moyo during sentencing yesterday.
"I also noted that you are a first offender and that you were provoked by the deceased, Evidence Thembani Ncube, who persistently proposed love to your wife."
According to a Chronicle report, Moyo, from the Bazha area of Matobo District, was 17 in January last year when he arrived home late from a beer drink and knifed his uncle.
"You took a kitchen knife, which was very sharp like a blade spear . . . your intention was to stab Ncube," the judge said.
"You could have opted to fight with your hands but it's clear that Ncube was older and much bigger than you in size, hence he would easily overpower you."
Justice Kamocha further noted that Moyo defied efforts by his aunt, Dorcas Ncube, who tried to calm him down and apologise on behalf of her husband.
Justice Kamocha said the age group of between 18-35 years was too ready to kill at the slightest provocation.
"They resort to using dangerous weapons, inflicting injuries to their victims," the judge added.
Prosecutors said Moyo had just returned from Botswana where he married his girlfriend, Thembinkosi Ncube, 18, when his 27-year-old uncle, Evidence, started proposing love to her.
Evidence, of Sigangatsha in Kezi, had come to Bazha in search of pastures for his cattle because of drought in his home area, and was staying at his sister, Dorcas Ncube's homestead in Bazha. Dorcas is Moyo's aunt.
The trial heard from Thembinkosi, who told how Evidence had proposed love to her on three occasions in December 2012.
Prosecutors said after warning Ncube to stop courting his wife on January 9 last year, Moyo left home for a beer drink and returned at midnight.
He threatened to burn Ncube in his hut, the court heard, before grabbing a kitchen knife and stabbed Ncube, who died within minutes.
Moyo insisted the killing was accidental, telling the judge that he wanted to stab him on the arm but caught him twice in his rib-cage, just below the heart.
