Gwanda Town Council has made a u-turn by withdrawing its court eviction bid on ex-mayor, Lionel De Necker.
The local authority filed its papers on February 25 in Gwanda. No reasons where cited.
Reads the withdrawal note : 'Take note that the applicant hereby withdraws its summary judgement application and tenders costs'.
The house is dispute is located at 306 6th Avenue. The town council has been seeking to kick out De Necker since he is no longer the mayor.
It said the house was allocated to him as mayor hence he should move out. He lost his council seat in the elections.
Council also says De Necker is in arrears amounting to over $2000 in rentals. However, he disputes that.
According to court papers, De Necker said council owes him $24 000.
"The applicant owes me over 24000 and whatever is owed to the municipality may be deducted therefrom" he said through his lawyers, Calderwood, Bryce Hendre and Partners.
De Necker was given 90 days last year in July for him to vacate the house but he stayed put. He said he got the house as a Gwanda resident and not as mayor.
