Juvenile begs magistrate not to incarcerate teenage boyfriend

A FORM Three girl from Victoria Falls begged the court not to incarcerate her boyfriend who impregnated her, telling the magistrate she wanted to marry him.

"Please don't imprison him. We want to continue dating and I will go back to school once the child grows," the juvenile told magistrate Sharon Rosemani.

The girl, aged 16, gave birth to a baby boy on February 18, this year after romping in the bush on numerous occasions with the 16 year-old schoolboy from the same school.

The two were in the same class. The boy is now doing Form Four while the girl is at home caring for the one-month-old baby.

The boy, an orphan whose parents died when he was only seven months-old in 1998, was staying with an aunt in Victoria Falls where he was attending school when he proposed love to the girl.

The two had literally turned a bush near Redstar Wholesalers in Victoria Falls into a romping zone as they would meet and have unprotected sex until the girl discovered she was pregnant in August last year.

The boy claims he is committed to marrying her.

"We are still dating and I am planning to marry her when I finish school. I have seen the baby, it's a boy. The mother is not going to school but she will go back once the baby grows," said the boy in court.

A probation officer said the boy was a victim of poor socialisation but recommended passing of sentence on him be postponed since he was still young and he and the girl had both agreed to have unprotected sex.

Magistrate Rosemani postponed passing of sentence for five years on condition that the boy does not commit an offence of a similar nature within that period.

The lad was being charged with two counts of having sex with a minor. The girl's mother told the court she was shocked by her daughter's behaviour but had accepted the fact that she is now a mother. She now wants the two families to meet for lobola rites.

Prosecuting, David Tivakudze told how the boy who had moved from Ntabazinduna Flats in Bulawayo to attend school in Victoria Falls met the girl from Chinotimba Township at school and proposed love to her on May 13, 2013.

"In June, the two agreed to meet at a bush near Redstar Shop.

The boy requested for sex and the girl told him she was afraid of falling pregnant but the two ended up having unprotected sex," said the prosecutor.

During the same month, the two were coming from church when they went again to their usual spot and had sex.  It is said the boy gave his sweetheart R5 after the sexual encounter. The girl discovered in August last year that she was pregnant and informed the boy who accepted responsibility for the pregnancy but the girl's mum detected the bulging stomach before the two minor lovebirds could act.

In September the girl's mother sent her daughter to the boy's place of residence to summon him but she did not return and instead stayed there for a month, the court heard.  The matter was then reported to the police leading to the boy's arrest.
