Man whipped over R20

A MANGWE man, 26, will perform 410 hours of community service for whipping an underessed neighbour following a dispute over R20.
Emmanuel Sibanda of Mzaza Village found Mandla Phuthi, 37, taking a bath in a river and demanded R20 that his parents had given him to buy beer.
Phuthi refused to comply with the demands and Sibanda armed himself with a whip and beat him several times all over the body, until he surrendered the money.
Prosecuting, Medica Tshuma said on June 12 Phuthi was drinking beer with Sibanda's parents and they gave him R20 to buy more beer from the shops.
Sibanda followed Phuthi.
"On his way to the shops the complainant decided to take a bath at Ingwizi River and passed by his homestead to take bathing soap. As he was taking a bath in the river, Sibanda followed him armed with a whip. He started whipping the complainant several times all over the body and ordered him to hand over the R20 note which his parents had given him. The complainant refused but Sibanda continued to whip him until he surrendered the money," said Tshuma.
The matter was reported to the police resulting in Sibanda's arrest. In his defence Sibanda told the court that Phuthi had disappeared with the money.
"I did whip him but it was because he had disappeared with my parents' money. He had gone for a long time and I decided to check on him. That is when I found him relaxed at the river and I had to force him to surrender the money as he was refusing," he said.
Plumtree magistrate, Gideon Ruvetsa sentenced Sibanda to 12 months imprisonment of which six months were suspended for five years on condition that he does not commit a similar offence within that period.
The remaining months were wholly suspended on condition that he performs 410 hours of community service at Empandeni Clinic.
"You did a stupid thing by beating up someone over such a petty issue. The money that you were beating him up for did not even belong to you. Now look at what your silly actions have cost you. You are lucky that I am not going to send you to prison but I am not going to leave you unpunished," he said.
