Businessman forced to take HIV test

A PROMINENT Maphisa businessman in Kezi, Matabeleland South province, has indicated that he would file a lawsuit against the police for allegedly being forced to take HIV tests on three different occasions as the cops investigated him for rape.

Patrick Finish Malaba (77) was last week acquitted of raping his then 16-year-old niece at his Maphisa home.

The girl had alleged that Malaba raped her on two different occasions in 2012 when her aunt was away in South Africa.

She claimed to have lost her virgnity to Malaba and contracted HIV as a result of the alleged rapes.

The girl, who is currently on anti-retroviral therapy, claimed she had only been intimate with Malaba.

However, Malaba's three different HIV test results returned negative forcing the State to withdraw the rape charges.

Through his lawyer Busani Dube of Cheda and Partners, Malaba is now seeking damages from the police for violation of his rights.

"We will now file a lawsuit against the police as they violated our client's dignity by forcibly taking him for HIV tests on three different occasions despite him testing negative," said Dube.
