Prostitute jailed for false rape report

A GWANDA prostitute will spend six months in jail for fabricating rape charges in an attempt to fix a client who demanded his money back after they had engaged in sex.

The commercial sex worker, Kudakwashe Grace Mahachi, 22, of no fixed abode, pleaded guilty to charges of deliberately supplying false information to the police when she appeared at the Gwanda magistrates' court on Wednesday.

She told magistrate Sheila Nazombe that she made a false rape report against one of her clients, Thembinkosi Nyoni, with the intention of fixing him for "using" her.

Nyoni, who spent about five days in remand prison charged with rape, was released on Wednesday when the State withdrew charges before plea after Mahachi had admitted to fabricating the matter.

"Your Worship, I'm appealing for your forgiveness. I was forced to make a false rape report because Nyoni had used me. He paid me $10 before I provided my sexual services. We had two rounds," said Mahachi.

"The problem was that he demanded his $10 back after accessing my services. This really hurt me and I had to lie to the police that he had raped me as I wanted to fix him."

In mitigation, the woman pleaded for leniency saying she was on antiretroviral treatment and was also asthmatic.

Mahachi also told the court that she realises about $500 per month in her prostitution business.

She was jailed for eight months, but two months were suspended on condition she does not commit a similar offence.

Magistrate Nazombe said in sentencing her, she had considered the seriousness of the offence and that Mahachi was a first offender.

Nazombe also said State resources which could have been channelled to other matters were wasted in the false rape investigation.

Prosecuting, Getrude Zvidzai said Mahachi made a false rape report to the police on September 28 this year alleging that she had been raped by four unknown men.

On October 25, she proceeded to the police and told them that she had spotted one of the men who had raped her at MaNkomo Beer garden leading to Nyoni's arrest.
