A NATIONAL University of Science and Technology student who made headlines in January this year after he allegedly bashed his 23-year-old girlfriend and locked her up in her room for two days until she had to excrete in a bucket was yesterday granted a protection order against her.
Tafadzwa Mhambwe, 23, of Riverside suburb, told Bulawayo provincial magistrate Evelyn Mashavakure that Ratidzaishe Mupinga of Selbourne Park suburb defamed his character when she falsely reported that he assaulted and kidnapped her.
Mhambwe said he was in a relationship with Mupinga for four years.
"Your worship, Mupinga has made my life miserable. She is peddling lies about me to B-Metro when l've never threatened or talked to her for the past four months," said Mhambwe.
"I've been detained under unclear circumstances for two days at Hillside Police Station when she reported the false claims. Her malicious actions have brought emotional stress and humiliation upon me."
Mhambwe said he is applying for a protection order against her so that she will never talk to him and to bar her from reporting falsehoods to the police.
Mupinga told the court she had not caused Mhambwe emotional distress but had let justice take its course after he beat her up and kidnapped her for two days.
"Your worship, I thought it was right to report him to the police after all that l went through. I didn't lie about the whole incident and the trial will start on Tuesday next week at the regional court," said Mupinga.
She further told the court that she never took her story to B-Metro.
Mupinga said court records were open to the public, adding the publication could have got the story there. Magistrate Mashavakure said it was not possible for the court to issue a court order barring Mupinga from making police reports.
She granted Mhambwe a protection order against Mupinga ordering her not to interfere with his life.
On January 20, this year, the matter was withdrawn before plea when Mupinga opted for an out of court settlement. Mhambwe was facing two counts of physical abuse and kidnapping.
The State alleges that on September 16, last year at around 8PM, Mhambwe visited Mupinga at her home.
Mupinga then asked him if they could end their relationship, leading to a squabble.
Mhambwe allegedly punched and kicked her all over the body before she managed to escape.
Nkululeko Ndlovu counselled the two.
According to the State outline, Ndlovu took the two back to Mupinga's home and Mhambwe locked her up in an attempt to conceal the assault.
Mhambwe would allegedly bring food for her and lock the door again. She was in her room from September 16 to 18 with only a bucket to use as a toilet.
He allegedly threatened to kill her if she reported the matter to the police and on September 19 he took her to hospital because the bruises were failing to heal.
Mhambwe then lied to the nurses saying Mupinga got the swollen face and bruises on her left arm after she fell.
The matter was reported to the police on October 2, last year, leading to his arrest.
