Axe-wielding man fondles minor

A 43-YEAR-OLD man from Bulilima will spend the next 18 months in prison for fondling a 13-year-old girl, in a bid to satisfy his sexual desires.

Senzangakhona Sibindi of Gonde Village, a married man and father of four, met the juvenile in a bushy area while she was on her way to visit relatives.

Sibindi, who was armed with an axe, kissed the girl and fondled her breasts, buttocks and private parts several times and threatened to strike her with the axe if she did not to comply.

He removed his trousers and then tried to remove the juvenile's clothes but she slipped from his grip and fled from the scene.

Sibindi was convicted of indecent assault by Plumtree magistrate Mr Livard Philemon.

Mr Philemon sentenced him to 24 months imprisonment of which six months were suspended for five years on condition that he does not within that period commit an offence of the same nature.

In his defence Sibindi, who admitted to the charges, told the court that he had no intention to use the axe but he wanted to juvenile to comply.

"What I said about striking her with the axe was just an empty threat Your Worship I just wanted her to do as I had commanded. I just wanted to touch her only and not kill her. I was carrying the axe just because I had been working in my garden. I was acting under the influence of the devil," said Sibindi.

Prosecuting, Mr Clemence Shawarira said Sibindi met his neighbour's daughter on 21 July around 10am.

He said the juvenile was walking along a foot path heading to Mangubo Village and Sibindi ran and caught up with her at a bushy area.

"Sibindi who is a neighbour to the juvenile hugged the girl and dragged her under a tree. He started kissing her and fondling her breasts, buttocks and private parts several times without her consent.

"He ordered the juvenile to lie down and he removed his trousers and remained half naked. He tried to remove her clothes but the juvenile slipped out of his hands and fled to a nearby homestead where she sought refuge," said Mr Shawarira.

He said the villagers took the girl to her parent's homestead where she narrated the ordeal and the matter was reported to the police.

Mr Shawarira said Sibindi was arrested and the axe which he used to threaten his victim was recovered.
