Zanu PF Council for ward 22 in Fort Rixon who is accused of illegally selling land at the Lochard Resettlement area to unsuspecting land seekers at between $400 and $500 for a given piece of land has been placed off remand after some witnesses failed to attend court for several times.
Edith Gumbo (43) was denying the illegal land selling charge when she appeared before Bulawayo magistrate Tawanda Muchemwa.
The magistrate had to refuse any further remand of Gumbo after the witnesses continued to abscond. State witnesses lined up to testify were Eloaf Dube, Daniel Hlongwane and Nkosinobuhle Hlongwane.
It appeared Daniel had not shown up to testify in the case for many times and at some point he was issued with a warrant of arrest which is still pending.
Prosecutors alleged that Gumbo on June 5, 2012 at Lochard business centre sold a piece of land to Mirriam Tshabangu for $400 after misrepresenting that the payment was for processing documents with the Insiza RDC where as the land was not for sale and she was not authorized to sell it or allocate it to anyone.
In count two Gumbo is alleged to have sold a piece of land to Daniel Hlongwane (43) of Njube in Bulawayo for $450 after misrepresenting that the money was meant for the processing of documents with the council yet the stand was not for sale and she was not authorized to sell it or allocate it to anyone.
On the same day Hlongwane's sister Nobuhle paid the money to Gumbo and after receiving the money she showed the piece of land to Hlongwane and later converted the money to her own use.
Hlongwane suffered a prejudice of $450 and nothing was recovered.
