A 13-YEAR-OLD boy from Gweru will spend the next two years under the supervision of a probation officer after he raped and impregnated his 14-year-old cousin. Gweru Regional Magistrate Collet Ncube convicted the boy on his own plea of guilty to one count of rape.
In passing sentence, Ncube said that he had taken into account that the teenager was a first offender who had pleaded guilty and did not waste the court's time.
"However, what you did was bad and you should be punished. You're still too young to go to jail but you should learn a lesson.
"The passing of your sentence is postponed for five years on condition you don't commit a similar offence. In addition, you will be placed under the supervision of a Probation Officer for two years," said Ncube.
Prosecuting, Emmanuel Matosi told the court that sometime in May this year at around 8PM, the boy was sleeping in the bedroom together with the 14-year-old girl, her younger brother and his younger brother.
"The four children were left at home by the boy's mother who had gone to Harare. The 13-year-old boy was sleeping on the bed with his brother while the 14-year-old girl was sleeping on the floor with her brother. The boy told the girl's younger brother to sleep on the bed," said Matosi.
He said that the juvenile said the bed was too hot for him so he wanted to sleep on the floor.
Matosi told the court that the boy removed the girl's panties while she was sleeping and got on top of her.
He said that when the girl woke up, the boy told him to keep quiet and raped her.
Matosi said the matter came to light on September 10 this year when the girl's aunt noticed that the girl was pregnant.
The girl told of the rape and the boy was arrested, the court heard.
