Gay man fined for indecent assault

A SELF-CONFESSED gay locked his friend in a house before undressing and caresing him as he intended to engage in sex with him, a court has heard.

Desire Kabango, 23, appeared before Binga magistrate Aeline Munamati charged with indecent assault.  He denied the charges but was fined $300 or three months in jail in default.

An additional three months were wholly suspended for five years on condition that he does not commit a similar crime within that period.

His victim, 27, who cannot be named for ethical reasons, gave testimony of how Kabango made advances on him on December 18 last year.

"He invited me to his house as we were drinking beer and as we arrived at home he immediately removed clothes and sat next to me on a sofa. He asked me if I was capable of keeping a secret and when I said I could he told me he was gay.

"He told me that he fell in love with me since the time he was introduced to me by my brother. He suddenly jumped onto me and started kissing me as I struggled to free myself.

"He started caresing my manhood and I pushed him away but he was so powerful as if he was possessed," he told the court.

Quizzed by the court why he committed the crime, Kabango blamed his actions on drunkenness.

"I'm sorry. I was drunk and I've since stopped drinking," he said.

The magistrate said he was lucky to escape with a lighter sentence because he didn't penetrate his victim.

Prosecuting, Bruce Maphosa said Kabango met his victim at a pub in Binga at about 10PM on December 18 and the two started drinking.

"He started buying beer for both of them and later invited the complainant to his house saying his brother-in-law and wife were not around and as such he didn't want to be alone at home, claiming he usually burnt food while cooking," said the prosecutor.

The court was told that the two arrived at Kabango's house at 11PM and he locked the doors after they entered.

Kabango put something on the stove before asking to use his victim's phone to play music, the court heard.

"He removed his clothes and remained with an underwear. He sat next to the complainant on the sofa and asked him if he could keep a secret. The accused confessed he was in love with the complainant before jumping onto him and started kissing after which he started caresing his manhood," said the prosecutor.

He said the complainant later ran towards the door but found it locked.

As Kabango kept advancing and pushing his victim, the court heard, he escaped through the window.

Kabango quickly unlocked the door and begged him not to report him to the police as he offered him $20.  The complainant reported the matter to the police resulting in Kabango's arrest. The victim's uncle also testified that his nephew knocked at his door at night and narrated his ordeal.
