THE trial of a Bulawayo woman who allegedly caused the death of her 77-year-old husband started with the woman claiming that she fought him in defence.
Celia Muneri, 75, allegedly pushed Takaidzwa Muneri during a domestic fight at their home in North End suburb sometime in October 2014, and he died on his way to hospital.
Initially, Muneri was charged with murder but it was later changed to culpable homicide.
She pleaded not guilty.
Dr Pesanai Sanganai, a pathologist who examined Muneri's body told regional magistrate Sibongile Msipa-Marondedze that he died due to acute cardiac failure.
"His heart stopped due a raptured liver he sustained during the fall," he said.
The woman's lawyer, Nomusa Ncube, applied for discharge at the close of the State case. The lawyer said the state, led by Tinashe Dzipe, had failed to prove the essential elements of the case.
Magistrate Msipa-Marondedze remanded Muneri to April 22 for the ruling on the application for discharge.
Dzipe alleged that on October 19 last year at around 10.50PM, Muneri and her husband were in their bedroom preparing to sleep when they had a misunderstanding which resulted in a fight.
Muneri then pushed her husband to the wall and he fell to the ground. She then sat on top of him and started assaulting him with open hands," said Dzipe.
"The husband shouted for help attracting the attention of his nephew who came to his rescue. The nephew also called his brother Tafadzwanashe who was sleeping in the cottage at the same house."
The court heard that the two discovered that their uncle was bleeding from the mouth. Tafadzwanashe then called an ambulance but after being told that they were all out, he decided to rush his uncle to Mater Dei Hospital in his own vehicle. Muneri was pronounced dead before he was admitted.
