Cop seek stay of trial against him over misconduct

A Bulawayo police officer has filed an urgent chamber application suing his bosses a trail Officer Superintendent Ndebele and the commissioner general of police seeking a court barring them from trying him over alleged misconduct.
The Constable Chirere force number 057119K filed his urgent Chamber application at the Bulawayo High Court on November 7 seeking reinstatement into the police force.
In his founding affidavit he submitted that on August 4 this year he appeared before Ndebele who charged him for contravening the Police Act but the allegations against him could not disclose the real offence he committed. He said as such the trial officer had no jurisdiction what so ever to try and convict him on an unclear allegation.
He said during the trial the trial officer did not record down the proceedings. He said he made an application to stay the trial which was granted by Ndebele who later wrote a letter to him for the trial to proceed. He said this prompted him to approach the court. He said it is clear that Ndebele will not try him in terms of the proper procedures and was likely to suffer harm if the trial continues.
He prayed for the stay of the trial.
