Kombi driver in court for ignoring police roadblock
08 May 2017 at 22:35hrs | Views
A 34 year old Kombi driver who caused a stir in November last year in Mvurwi after he was arrested by three traffic police officers two days after allegedly running away from their roadblock.
According to state papers, three traffic police constable Murwira, William and Chahuruva handcuffed Kombi driver Tichaona Sibanda at Mvurwi bus terminus on 24 November 2016, accusing him of running away from a police road block 2 days before.
Sibanda twisted the handcuffs when the police tried to handcuff him prompting council officer Cosmas Maroto to intervene and convince the accused to be arrested.
The trio charged the accused with two counts of resisting arrest and failing to stop at a roadblock thereby contravening the Road Traffic Act section 43 1 (b).
The accused is being represented by Nancy Mabhoyi and on the first charge of resisting arrest he has been acquitted by Guruve magistrate.
Sibanda told the court that he did not resist arrest but instead resisted to be handcuffed and his words were supported by the witness Maroto.
Appearing today (Monday) for failure to comply with police instructions, Sibanda told the court that the cops did not put police road signs causing him to just pass. The cops then emerged from nowhere.
The cops argued that they were conducting a blitz and it was not mandatory to place the "police ahead" signs.
The magistrate deferred the matter to 15 May and indicated that he needed to consult with the relevant legislation before passing judgment on the matter.
