Was the policeman wrong for throwing spikes on the road or the driver?

This is from a rational point of view.

This article concerns the recent incident that happened on Khami road which ended with the crowd attacking police officers after one of them had thrown spikes on the road resulting to an accident that left passengers seriously injured. Now the question is, Was the policeman wrong for throwing the spikes? This article serves to unravel on that by scrutinizing the circumstances circumventing the incident. Many people are furious about the throwing of spikes and are happy that the cops were attacked and they wish they should have been killed.

To start with, the place of occurrence. Was the drive supposed to be there when the accident occurred? No he wasn't. Why? He diverted from Luveve road evading cops. Why? He is 23years and by law he's not supposed to be a PSV driver because the law permits those who are 25 and or above. He doesn't have medical, he doesn't have  re test, he doesn't have defensive one may suspect. The driver or the media claims he didn't want to bribe the police which is good. Don't pay bribe to police officers to eradicate corruption.

The driver seems to be a law abiding citizen but from the listed above i'am starting to doubt. Ok back to our story, with the above listed offenses and the ones undetected coupled by the owner's offense he is liable to paying at least $100 - $140 fine. It is said that the police demand $4 the whole day, $2 apart twice a day. So why didn't the driver request a  $100 ticket than bribe the cops $2. Did the cops ask for bribe? No he assumed. If a police officer solicits for bribery effect a citizen arrest or expose him. The cops didn't ask for bribe he just diverted.

Now he gets to Khami road, there's a police ahead sign, these days it's assumed it's there because cops were given such directive. What does a drive do when he sees a police ahead sign? He must slow down. Did the kombi driver slow down? No. He's quite a different kind of a law abiding citizen. He was stopped by the cops but he didn't want to stop or show any intention to. Failure to obey a sign given by a police officer on duty is a grave traffic offense because failure to do so may lead to fatal accidents or repercussions. Directions or signs or instructions given by a police officer exercising his lawful duty over ride even those of traffic signs or robots. What happened when he showed no sign of stopping? The cop threw the spike on the road.

Now, is it lawful to throw spikes on the road? It is lawful only and only if the driver of a vehicle shows no sign of obeying instructions given by a police officer to stop. Was the driver in such a position of showing such intention or that can be presumed so? Certainly yes he was trying to run away from the cops. What a lawful abiding citizen? What's the objective of using spikes? It is to force a stop in that the vehicle with on then thereby damaging tires. They are not used so that the drivers make dangerous and unreasonable acute turns that put other people at risk. The purpose of defensive driving or the reason why our requires a PSV driver to above 25 is for drivers to understand the importance of passenger safety. It's for drivers to understand the sacrifices they must make to safeguard the safety of passengers including running over spikes to damage your tires but with no passenger injured, hitting a dog on the road and damage your lancers but with everyone safe. The kombi driver's age disqualifies him to understand that or from such maturity or experience required of a driver to understand such. He tried to avoided spikes so that he won't be arrested for offenses mentioned above at the expense of passengers he had. Why because he is not at a stage where he understand the concept of being a PSV driver. Had he not avoided spikes no one would have been injured. Spikes were not first used in him, they have been in use since time immemorial but with no such results. Had they produced such result they would have been banned long back. Note that spikes are not only used in Zimbabwe but world over.

Guns are primarily to be used on humans but it of necessity. There are best candidates for that. The cop was not wrong I personally blame him for not realizing that he was not dealing with a normal human being which later led to an inimical result. It's unfortunate that people were seriously injured but it is not on the cop but the driver. It's disappointing that people attacked the cops due to lack of knowledge and reasoning capacity. Yes they are corrupt fight their corruption and no other. What if the driver had stolen the car or if it was a thief in your yard armed? Would you say cops are wrong if they shoot him on the leg? This example is proportional. For armed criminals guns are used to shoot them and it's lawful. For traffic offenders spikes are used and it's lawful. It's sad that the people attacked the cops.

I love cops though sometimes I hate their deeds. They are there to safeguard my rights. They are part of the executive hence by attacking them they committed a crime against the state. The state is not the president or minister but it's me represented by government officials.The mob undermined my right of protection and security. Being driven by a lawfully prohibited driver put my life at risk hence I have to be protected from that and for this reason the mob undermined my right to that protection. I personally disapprove of that act by the mob. Why don't you attack the cops when they are trying to effect am arrest on thieves after stealing your property or rapists because all of these inclusive of the kombi drive are on the wrong side of the law.
