Mbofana sue Dynamos FC

SWAZILAND-based Zimbabwean soccer coach Phillip Mbofana has dragged South African outfit Dynamos to court and successfully sued the National First Division side for breaching the contract they had with the gaffer, writes Petros Kausiyo in MBABANE, Swaziland.

Mbofana, who barely lasted four months at the Polokwane-based side is demanding and has been awarded the right to claim R105 000, which amounts to three months' salary that he should receive as compensation for having his contract terminated prematurely.

According to an order issued in Polokwane on November 11, Dynamos should have paid Mbofana the full amount by November 19 but the South African club is still to deposit the money through the coach's lawyers and could be further penalised for breaching the order they had consented to.

It was ordered that:

l The contract of employment between the parties is hereby terminated by mutual consent with effect from the 11th November 2010.

l The former employee (herein referred to as the coach) will be paid a three-month salary (which will be his gross) on or before the 19th November 2010.

l This is in full and final settlement between the parties.

After the issuing of the order, Mbofana then wrote to Dynamos directing them to pay the money through his South African-based legal representative Tendai Toto's Standard Bank account.

"I Phillip Mbofana of 2487 Mainway Meadows, Harare, do hereby authorise Dynamos Football Club to make the R105 000 payment on my behalf to T. Toto Legal consulting SA as per our consensual agreement to terminate my contract with effect from 11 November 2010," read part of Mbofana's letter.

But a month after the execution of the order Dynamos are still to honour their obligation prompting the coach to seek further legal action in order to have the matter brought to finality.

Mbofana's agent Ali Tholoeale was not amused by Dynamos' conduct and indicated that they would seek a writ of execution against the club in order to recover the money.

"We are going to apply for a writ of execution on their PSL monthly grant in order to get that money . . . They have shown that they are shameless anyway," Tholoeale said.

Mbofana, who has literally set up base in Swaziland where he has taken charge of XI Men in Flight, Hellenic and Mbabane Highlanders in the Premiership, is back in the mountain kingdom after his switch to South Africa ended prematurely and in somewhat acrimonious circumstances.

This is because the coach was also facing charges that he had raped his girlfriend in Polokwane. Mbofana has denied the charges and the hearing of the matter in a Polokwane magistrate's court has been postponed indefinitely following a request by the South African police for more time to continue with their investigations.
