Injiva denied bail for murder

FOUR men including an injiva appeared in court yesterday facing charges of assaulting to death a man they found in the injiva's bedroom at a house in Nkulumane.
Nobukhosi Ndlovu (27), the injiva, who stays at House Number 59619/4 Iminyela, Alois Moyo (22), of Number 58117/3 Mabutweni, Mcedisi Ndlovu (22), of B177 Njube and Jacob Banda (27), of House Number B166 Njube, were not formally charged with murder when they appeared before Bulawayo provincial magistrate, Mr Richard Ramaboea sitting at Western Commonage magistrates' courts.
Moyo, Mcedisi and Banda were granted $100 bail with the consent of the State and were ordered to report once a week, every Friday, to Njube Police Station.
They were further ordered not to interfere with State witnesses.
Nobukhosi was denied bail on the grounds that he holds a South African passport in the name Sibusiso Khumalo and the fact that he is the principal offender.
Nobukhosi, in his bail application through Advocate Sabelo Sibanda, of Adv SKM Sibanda and Partners claimed that the deceased Tatenda Mahove (24) first attacked him and that he acted in self-defence.
The quartet will next appear in court on 29 June. The area public prosecutor for Western Commonage magistrates' courts, Mr Dan Ndebele, told the court that Nobukhosi, who works in South Africa, got wind that his wife Ester Phiri (24) was staying with a lover at their rented accommodation at House Number 845 Nkulumane.
On 10 June he arrived in Zimbabwe from Johannesburg, South Africa, and went to allegedly seek assistance from his accomplices.
At around 9pm the quartet left for Nkulumane and when they got to the rented house, Nobukhosi knocked on the door and Ms Phiri answered the knock.
When she opened the door, and on realising that it was her husband, she bolted out in a semi-naked state with the maid following her.
Nobukhosi proceeded to the bedroom where he found Mahove sleeping in the matrimonial bed naked. Next to him was Nobukhosi's three-year-old daughter, who was sharing the bed with them.
Nobukhosi confronted Mahove and the State alleges that he assaulted him on the head several times with a knobkerrie.
Mahove later died from the injuries he had sustained and neighbours discovered his body on the following day at 5.45am.
The trio of Moyo, Mcedisi and Banda allegedly remained outside the house standing guard.
The quartet surrendered themselves to the police at Nkulumane in the company of Adv Sibanda on Wednesday.
