TWO men, aged 20 and 23, who felt hard done by a cheating girlfriend (17) recently appeared before Mutare magistrate, Mr Langton Mukwengi, facing assault and theft charges.
The duo, George Zeya and Gerald Katize who were both in a love relationship with the juvenile from Chikanga high-density suburb went on to grab her cell-phone and $300.
They were found guilty of contravening Criminal Law Codification and Reform Act, Chapter 9:23 (assault).
Zeya was also found guilty for contravening Criminal Law Codification and Reform Act, Chapter 9:23 (theft).
Katize was, however, acquitted on theft charges.
Sentencing them, Mr Mukwengi ordered the duo to pay $50 fine or face 40 days imprisonment on assault charges. He also slapped Zeya with two months imprisonment which was wholly suspended on condition that he restitutes the juvenile $300 before March 30.
In a State case led by Mr Fletcher Karombe, the court heard that the juvenile, on February 2, at around 9am, was tasked by her mother to go and cash in $300 to the Eco-cash shop agent.
"She called Zeya and informed him to meet her at TM Supermarket in Chikanga 2 since they were lovers. Upon approaching the place, she realised that Zeya and Katize were standing together waiting for her.
"The juvenile went on to confront them after she realised that she had double-crossed them. The duo became violent and started assaulting her with open hands, fists and wooden stick all over her body. The complainant fell unconscious for a few minutes and her sister fled to inform their parents. The two accused took away the complainant's Nokia X2 cell phone and $300 when the complainant was unconscious.
They went away. She sustained moderate injuries. The cellphone was later recovered from Zeya," said Mr Karombe.
