Harare High Court Judge, Justice Chinembiri Bhunu today reserved judgment in an application by MDC-T Secretary-General and Finance Minister, Tendai Biti in which he is interdicting the police from accessing information from his mobile phone lines.
Last week, Biti filed an urgent chamber application interdicting the police from accessing information from his cellphones as it was a form of harassment. This was after a Harare provincial magistrate; Mishrod Guvamombe had issued the police a warrant of seizure.
Tendai Biti filed three separate High Court applications to bar the Zimbabwe police from accessing information on calls made from his Econet cellphone lines. The Econet mobile phone lines were released by the police to the court yesterday.
The Criminal Investigations Department's Serious Fraud Squad, armed with a warrant issued by Harare provincial magistrate Mr Mishrod Guvamombe, is alleged to have approached Econet officials threatening them with arrest for non-compliance with the order.
Although the scope of police investigations is as yet unknown, Biti argues that the release of the required information amounted to harassment and infringement of his fundamental rights.
