BCC employee, accomplice steal beer worth $1900

A BULAWAYO City Council employee has been arrested on charges of stealing beer worth $1900 at Guzzlers Sports bar in Queenspark, Bulawayo.

Mandlenkosi Tshuma (30) and his alleged accomplice, Marvelous Ndlovu (28) plead guilty to unlawful entry when they appeared before Bulawayo magistrate Lizwe Jamela.

They were also being charged with illegal possession of dagga and they had both pleaded guilty.

However, Tshuma was acquitted after plea by the magistrate who stated that according to the facts in the state outline Ndlovu is the one who had been found in possession of the dagga.

Ndlovu was sentenced to 24 months in prison for unlawful entry into premises committed in aggravating circumstances and three months were suspended for five years on condition of good behaviour.

"A further three months in prison was suspended on condition that the accused person resituates the complainant $677 before March 30 this year," he said.

Two months in prison was added to Ndlovu's sentence from his previous conviction in 2016, as such he will serve an effective 20 months in prison.

Ndlovu was further fined $400 or he risks being in prison for 30 days for possession of dagga.

 Tshuma was sentenced to 18 months in prison for theft of beer and three months were suspended for five years.

A further three months was suspended on condition he resituates Lennox Muhlambi (33) owner of the Guzzlers Sports bar who resides at Mahatshula suburb $677 before March 30.

He will serve an effective 12 months in prison.

The court was told that on February 16 at around 12 midnight, Muhlambi knocked off duty and before leaving the premises, he secured the spots bar by locking the doors and went home.

During his absence the two came, force opened the door and gained entry into the sports bar.

It is alleged that whilst they were inside they stole three Viceroy of 750ml, five Chateau of 750ml, two gold Blend whisky, four Gold Black whisky of 750ml, two 750ml Heritage and 19 cigarette lighters.

On the same day information was received by the police officers leading to the arrest of the two and recovered one bottle of 750ml of Viceroy, one bottle of 750ml of Gold Blend Whisky, one bottle of 750ml Gold Black Whisky and 15 cigarette lighters at Ndlovu residential place.

The property stolen was valued at $1904 and property value of $550 was recovered.

In another case Ndlovu is being charged with the criminal law (Codification and Reform) Act Chapter 9:23 (Posses of Dagga)

The court was told that on February 16 at around 11am, police officers from ZRP Queenspark suburb, Bulawayo conducted a search at his residential place at Queenspark East.

It is alleged that during the search the police recovered some loose dagga from his room.

Upon being interviewed by the police officers he implicated Tshuma.

The recovered dagga and the two were referred two Central Investigative Detectives (CID) for management.

The dagga weighed at 65 grams and it was valued at $650.
