PPC embroiled in US$72,600 cement supply dispute
Bulawayo-based Erksales Hardware has accused PPC Zimbabwe and one of its employees, Nicole Botha, of failing to deliver 330 tonnes of cement allegedly purchased and fully paid for last year.
Erksales Investments (Private) Limited, the parent company of Erksales Hardware, is seeking compensation from PPC Zimbabwe over the alleged non-delivery of eleven 30-tonne truckloads of cement, valued at approximately US$72,600 at current market prices.
The dispute is set to return to the High Court in Bulawayo on November 6, 2026, when the court hears an application by Erksales Hardware to have the matter reinstated.
According to a notice issued by the High Court on October 14, the matter, registered under case number HCBC835/26, has been set down before Justice Ndhlovu.
Court documents seen by Bulawayo24.com indicate that the cement was allegedly purchased through a PPC Zimbabwe sales representative in 2025, but the product was never delivered despite full payment allegedly having been made.
The initial application was struck off the roll after PPC Zimbabwe and Botha opposed the claim, prompting Erksales Hardware to file a fresh application seeking reinstatement of the matter.
The court notice confirms that the reinstatement application will be heard on November 6.
However, the court documents do not specify the reasons for the original dismissal, nor do they outline the basis upon which PPC Zimbabwe and Botha opposed the application.
It is also not clear whether the respondents intend to maintain their opposition when the matter returns to court.
The upcoming hearing will focus solely on whether the case should be reinstated.
Should the court grant the reinstatement application, PPC Zimbabwe and Botha would then be required to respond to the substantive allegations in subsequent court proceedings.
The case remains before the courts and the allegations against PPC Zimbabwe and Botha have not been tested in court.
