Man breaks in to undressed bathing woman's house

A man who allegedly forcibly opened a bathroom door where his female neighbour was undressed and bathing at Sakubva  has been taken to courts over the intrusion.

Desmond Kaparinje (28) of OTS section of Sakubva denied criminal insult charges as defined in Section 95(1)(b) of the Criminal Law (Codification and Reform) Act, Chapter 9: 23 when he appeared before Mutare senior magistrate, Sekai Chiundura last Friday.

Prosecuting was  Fletcher Karombe.

It was the State's case that Shatel Tore was taking a bath in her bathroom when Kaparinje came and forcibly opened the door.

"Complainant heard some footsteps outside as she was bathing and asked who it was.

"Kaparinje, however, forcibly opened the bathroom door and feasted on the naked 18-year-old's body with his eyes. When she shouted at Kaparinje telling him to close the door and leave the bathroom," he refused.

"He went on to threaten to assault the complainant in her naked state," said Mr Karombe.

It was also stated that the complainant's landlord, Mrs Beckham, after hearing the shouts came outside and found Kaparinje in the bathroom before he left.

Responding to the allegations, Kaparinje told the court that he had not forcibly opened the bathroom door, but that the complainant was bathing with the door open.

"I was not peeping, but she was actually displaying her own body since the door was open.

"The bathroom is situated just beside the path that I use to and fro my home so I was even surprised when I saw her bathing with an open door.

"Who does that seriously?," he asked the court sarcastically.

Kapirinje was remanded out of custody to December 28 for trial.
