A RUSAPE teacher based at Chironga Primary School – Revai Kaswa – accused of abusing his female pupils was last week acquitted of five counts of aggravated indecent assault and another five of indecent assault.
According to Manica Post, Kaswa was cleared of the charges after a full trial by Rusape regional magistrate, Livingstone Chipadza for lack of evidence.
Chipadza said the witnesses were inconsistent and should have been coached by one Pindura, who is believed to be the author of the allegations.
Chipadze also queried how Kaswa would abuse the complainants in class and in the absence of other children.
Chipadza noted glaring disparities in the complainants' versions to the police, reports to the Ministry of Primary and Secondary Education and in court – thereby adding credence to claims by Kaswa that the allegations were fabricated by some of his workmates to fix him.
A medical report produced in court also worked in Kaswa's favour after showing that the private parts of the five complainants who had alleged aggravated indecent assault were intact.
The girls had told the court that Kaswa touched and inserted his fingers in their genitals on different occasions, acts which they added, were painful.
It was the State case led by Tirivanhu Mutyasira that Kaswa on different occasions touched and inserted his fingers in the schoolgirls' genitals as well as taking pictures.
