A 52-year-old Chipinge woman has dragged a 65-year-old grandpa to court claiming that he caressed her private parts while she was dozing off on a sofa.
The plaintiff, Violet Chiradza, last week filed a $10 00 sexual harassment and assault damages against Isaiah Mafara at the Chipinge Civil Courts.
Mr Poterai Gwezhira heard the matter.
Through her attorney, Mr Langton Mhungu of Matutu, Kwirira and Associates, Chiradza said the defendant harassed her on October 20 last year.
She said Mafara visited her house at No. 1417 Gaza O in Chipinge and entered without her consent.
"Your Worship, the defendant came to my house late at around 10.30pm and entered my house without my consent. I was fast asleep on the sofa when Mafara sexually assaulted me. He inserted his fingers in my private parts, hurting me in the process.
"Had it not been for my son who arrived before things got worse, I don't know what would have happened because he was forcing himself on me," she said.
"I lost my dignity because of the incident. I am no longer enjoying good relations with some of my family members because they are not sure if I had consented to his actions. My husband is no longer interested in me. Because of this incident I am now suffering from high blood pressure.
"He promised to compensate me for the damages he caused, but he never lived up to his word. He has applied a protection order against me as a way of running away from this matter," she said.
Mr Mhungu said the defendant's actions amounted to attempted rape since he preyed on an unsuspecting woman.
He produced hospital scans as evidence to show that the defendant had indeed violated his client.
"In my client's own description, the defendant forced himself on her and went on to fondle her private parts and ejaculated on her. This vivid description and the fact that she tried to fight him off has very similar undertones of attempted rape," he said.
Mafara said he did not want the matter to spill into the courts.
"On November 26 last year, we had a written agreement with the applicant that I should pay her for my actions. In the agreement I asked for forgiveness and we agreed that I will pay $500 as well as foot all the medical expenses. I am in the process of paying her the money," he said.
Mr Gwezhira is still to set the hearing date.
