Nurse slapped with $7 000 adultery damages

A CHIPINGE Rural District nurse stationed at Mutema Clinic is ruing the time she had an affair with a married man after the Civil Court ordered her to pay $7 000 adultery damages.
The nurse, Mugove Gumeyi, was last year sued by Ida Kamuloni (38) nee Chandomba of House Number 4278, medium-density, Chipinge for having an extra-marital affair with her husband, Try Kamuloni before siring children together.
Ida Kamuloni proved that she married Try Kamuloni under the Marriage Act, Chapter 5:11. Chipinge magistrate, Mr Vuso Gapara on January 2 ruled that Gumeyi should pay $7 000 adultery damages with immediate effect.
"Judgement be and is hereby entered for plaintiff in the sum of $7 000 with costs," read part of the judgement.
According to the summons, Ida Kamuloni who is the plaintiff was claiming that Gumeyi destroyed her marriage by being in an adulterous affair with her husband. She claimed that Gumeyi and Try Kamuloni sired three children out of wedlock.
"On various occasion in Chipinge, Mugove Gumeyi unlawfully associated with my husband, Try Kamuloni and engaged in an intimate relationship knowingly and well aware of our marital status.
"I tried to plead with the defendant several times to stop the affair, but to no avail. My husband left our matrimonial home and relocated to Mutema area where the defendant is working.
"Their relationship hurt and impaired my dignity in the community. I also lost love, care of my children and conjugal rights from my husband as a result of this adulterous relationship. Therefore that is why I claim the payment of $10 000 adulterous damages," she claimed.
However, through her attorneys, Gwamanda Law Firm, Gumeyi (defendant) dismissed Ida Kamuloni's claims and argued that she was married to Try Kamuloni under unregistered customary law which was ruled out by Mr Gapara.
She further argued that before Ida Kamuloni had upgraded her customary marriage through a wedding, the defendant (Gumeyi) was already married to Try Kamuloni under the customary law.
In interview soon after collecting her judgement, Kamuloni, said: "I am happy with the judgement and I hope the world is now viewing me and my children in another way.
"I am in the process of collecting gnashing order papers from the court so that I can recover the $7 000 soonest," said an elated Kamuloni.
