Ex-Soldier up for $125,000 maintenance arrears

AN ex-soldier was yesterday hauled to court to answer to charges of defaulting maintenance in arrears of over $125 000.
Shupikai Vito was not asked to plead when he appeared before Harare magistrate Rumbidzai Mugwagwa.
Allegations are that on August 1, 2008 at the High Court of Zimbabwe, Vito was ordered by the court to pay 50 percent of school fees per term for his then two minor children.
The complainant is Engeline Zachariah Vito his ex-wife.
Vito was ordered to pay school fees with effect from September 30 2008, and that all the subsequent payments were to be made on or before the end of each term however he did not pay 50 percent of the fees and he is now in arrears of $125 496.
The two got married in 1992 and Shupikai Vito filed for divorce against his wife in 2006 however she entered her plea and also counterclaimed while accusations of infidelity were made by each other against the other.
They both agreed that the mother of the children be granted custody but proceeded to trial over the equitable distribution of their house in Borrowdale Brooke.
The High Court ruled that the property was be sold when both minor children were over 18 and as it stands, the oldest is 26 and the youngest is now 18 but the property has not be sold yet.
Vito was released on free bail and the matter was remanded to November 7.
