Three individuals suspected of cattle rustling have filed an application with the High Court requesting the recusal of Plumtree magistrate Joshua Nembaware from their case.
The suspects, namely Shelton Dube (21), Sibangiswani Ncube (48), and Gilbert Ncube, presented the application through their legal representative, Nqobani Sithole.
They cited bias on the part of Nembaware following his dismissal of their bail application. Although the trial was scheduled to commence yesterday before Nembaware, one of the suspects' lawyers was absent. As a result, the trial has been postponed until May 30.
According to the State represented by Roben Mukura, the trio allegedly conspired to steal 18 cattle from grazing paddocks at Lydead Farm in Matebeleland South on January 28.
