Supreme Court reinstates 5 soldiers

The Supreme Court, led by Justices Samuel Kudya, Joseph Musakwa, and Susan Mavangira, reinstated five Zimbabwe National Army (ZNA) members who were dismissed for alleged theft of food rations. The soldiers were reinstated with full salaries.
This decision came after the army commander challenged a High Court ruling that had reinstated the soldiers.
Despite being acquitted by the Court Martial, they were dismissed, prompting them to seek a review.
The Supreme Court sided with the soldiers, stating that the dismissal violated a statute and lacked procedural fairness.
The soldiers' request for the record of proceedings from the Board of Suitability (BOS) was denied, leading them to appeal to the High Court, which ruled in their favor and ordered their reinstatement.
The BOS, aggrieved by the High Court ruling, appealed to the Supreme Court, arguing that the decision to be reviewed was that of the commander, not the Court Martial.
