Teen convicted of sodomising brother(6)

A 15-YEAR-OLD boy will receive four strokes of the cane after he was convicted of sodomising his six-year-old stepbrother.
The Zimre teenager was facing aggravated indecent assault as defined in Section 66 of the Criminal Law (Codification and Reform) Act. Harare regional magistrate Noel Mupeiwa sentenced ordered the teenager to receive four strokes of ratten cane at Harare Remand Prison.
In addition the teenager was slapped with 12 months imprisonment wholly suspended on condition that he will not commit an offence of a sexual nature for the next five years.
"The sentence (of caning ) is to be executed in private after the accused has been certified fit by a medical doctor or any other authorised medical practitioner to receive such sentence.
"The parents or guardians of the accused person are authorised to be present during the execution of the sentence," Mr Mupeiwa said in passing sentence.
The magistrate also ordered the teenager and his parents as well as his stepmother to undergo counselling at the Department of Social Services in Goromonzi or any other institution.
Proven facts are that on an unknown date between January and March, the teenager took advantage of their parents' absence to quench his puberty sexual desires.
He removed his step brother's clothes before molesting the small boy. The matter was discovered by his stepmother who is mother to the complainant.
