CIO dirty hand exposed in Lupane court

Mthwakazi Republic Party is pleased that the court has acquitted the four villagers of Mlamuli Secondary School in Lupane. It is alleged that on the 27th of June 2016 at Mlamuli Secondary School in Lupane. The accused persons contravened section 45 (a) of the Criminal Codification and Reform Act Chapter 9: 23.
They intimidated Millet Bonyongwe to hand over to them her School residential cottage keys and to leave to her place of origin since she was a Shona speaking person. It is also alleged that accused threatened her with unspecified action if she did not leave. Through their Lawyer Dumisani Dube, the accused then made an application for the matter to be referred to Constitutional court which was dismissed by Magistrate Ndumo Masuku.
Surprisingly Mrs Bonyongwe denied ever reporting the matter to the police or being the complainant. This was confirmed by another teacher Mr Zibusiso Masuku who said the accused were simply following resolutions made by the community for Bonyongwe to leave Mlamuli and hand over the school keys, resolutions which were made in a properly constituted SDC and parents meeting which was attended by ZRP, and education officials on the 23 third of June 2016.
The villagers through their Lawyer requested the state to acquit the villagers as there was no case to answer but police were pushing their hidden agenda to intimidate villagers through Sergeant Darlington Hochi who told the court that he works for police criminal intelligence and was told by his intelligence sources that Ndebele people had chased away a Shona headmistress from Mlamuli Secondary School.
The State prosecutor Mr Ndlovu conceded to the application by villager's Lawyer Mr Dumisani Dube and told the court that since Bonyongwe denied making the report or being the complainant they had no case.
In acquitting the villagers the Magistrate stated that putting the accused to defence where the state has failed to prove a prima- facie case is a violation of their right to free trial. This is a clear case of exhibition by police unprofessional conduct in which they manufactured a case together with the purported complainant.
In a case where the community had conducted themselves in a lawful manner in pursuit of their rights. It baffles the court why the police played such a partisan role and clearly political role in this case as has been alluded to by defense lawyer Mr Dumisani Dube is disturbing.
This court bemoans the degree of policing standards in this case and wastage of resources. In summary the accused are discharged at the close of State case.
