Bosso fan 'murderers' released but still to answer to murder charges

THE claim by three Dynamos fans accused of killing a Highlanders supporter that they never stabbed Thembinkosi Hloli but he fell on the spikes of a gate, is not supported by post-mortem results.
The trio, Emmason Msipa (44), Honest Makhala (28), Onisimo Maphosa (33), who were chasing Hloli as he scaled the Tabs Avon spiked gate, still have to answer to murder charges.
Their evidence is that Hloli was stabbed by the gate spikes. However, the conclusion in the post-mortem disputes the assertion.
According to the State's investigations, the types of spikes that are on top of Tabs Avon gate measure 13cm in length, 3cm in width and are 10cm apart.
The post-mortem report obtained by Sunday News shows that Hloli died as a result of violence. The stab wounds showed that Hloli had two stab wounds which were 16cm apart while the spikes alleged to have stabbed Hloli are 10cm apart.
In addition, according to the same post-mortem the width of the wounds is 0,5cm instead of the 3cm which is the width of spikes at the Tabs Avon gate. From the investigating officer's observations, as well as the security guards there was no blood on the Tabs Avon spike gates.
"Also if the deceased sustained the two wounds from being pierced or stabbed by the spikes it would have been logical that the wounds be at least 10cm apart as opposed to being 16cm apart as shown by the post-mortem report and as well as being of the same circumference as the spikes of the gate," reads part of the State's legal opinion.
"In the premises, accused one, two, and three have a case to answer since they ran after the now deceased and later they were the same people seen whilst the now deceased was lying on the ground unconscious with the wounds on his lower abdomen."
The three accused are remanded out of custody while the State carries out further investigations.
Six out of nine Dynamos fans who were charged for murdering Hloli about a month ago have been released from custody by the State due to lack of evidence implicating them.
The nine suspects were charged for killing of Thembinkosi Hloli after he and his two friends, Nkosiphile Lusinga and Decent Sibanda, smashed the window of a car that the Dynamos supporters were travelling in from a soccer match in Barbourfields won by the Harare side 1-0.
The six accused who were released are George Chapindura (43), Rodger Dietrechsen (42), Pretty Ndora (27), Nandi Nyoni (31) and Margaret Mpofu (23), as well Chamas Misiwo, a police officer stationed in Hwange who was driving the car and is Mpofu's boyfriend.
