Dembare, NetOne lies exposed
11 Apr 2018 at 05:01hrs | Views
As the Epoupa drama was unravelling, his camp was engaging services of a top lawyer (name supplied) who tackled matters from a legal point of view with the help of Footballers Union of Zimbabwe all along.
LETTERS OF ENGAGEMENT
Dembare Dotcoms, as we post now, are in possession of letters of engagement written by Epoupa's camp to the Dynamos executive after Dembare were found wanting from a football legal perspective of the saga. In short not honouring their contractual obligations.
We can exclusively reveal that the letters of engagement were written on 19 February 2018(FIRST DEFAULT), 20 March 2018(SECOND DEFAULT) and 27 March 2018(FINAL DEFAULT), but Dynamos never bothered to respond, let alone take action to settle the players owed amount.
Details of the letters included:
i) Dynamos to pay the player's owing signing on fees, outstanding salary, and allowances as stipulated in the contract
ii) Renewing the player's work permit as his employers as stipulated in the contract.
iii) Issuing the player's medical insurance which states that the club will bear the player's medical needs in case of injury or illness as stipulated in the contract.
iv) offer the player proper accomodation as his current living conditions are deemed unsuitable and the furniture he is using has been donated by a well wisher.
v) $12000 sign on fee which was supposed to be paid by the 18th of March as per the contract agreement.
vi) food and allowances dating back to May 2017 , please note Epoupa was not entitled to any winning bonuses at Dynamos FC.
.......
FIRST LETTER- 19/02/18
In the first letter dated 19 February, The club was given 21 days to solve the outstanding issues, or at least respond. 21 days elapsed on March 12 2018 but the club had not taken any action, not even a response.
SECOND LETTER- 20/03/18
The 21 days had ellapsed and the Epoupa camp gave the team an extra 8 days before writting another letter. The second letter clearly stated that failure to honour the contractual obligations, that would be a breach of contract and would result in the termination of the players contract. Again the club did not respond. Rather, they passed propaganda correspondence through newspapers.
THIRD AND FINAL LETTER:27/03/18
This letter gave Dynamos an option to meet the contractual demands in 48 Hours , or at least to respond. Dembare did none of the above. The player was left with no option but to send a letter of termination of contract on 5 April 2018, after giving Dynamos an extra 8 days grace period.
EPOUPA RETURNS MONEY?
On the day Epoupa terminated the contract, his OneMoney Account had a total of $3758 for January, February and March salaries. End of March, NetOne had intervened and deposited $5100 ONLY into Epoupa's bank account, which was still not enough as according to the contract, he was supposed to be paid $12000 before 17 March 2018, the day the season commenced. It is a lie that they gave him $18 125 , if they deposited they did it when they knew Epoupa had terminated his contract and surrendered his NetOne line.
So upon submission of his contract termination, he also returned a NetOne simCard with a total of $8 858 that he had not withdrawn due to the cash crisis prevailing in Zimbabwean banks. Fact is after Dynamos had deposited his salary $3 758 salary, he had pleaded with them to give it to him in cash, even Bond notes, so he could work something out to send cash to his stranded family back in Cameroon.
DEMBARE RISK FIFA SANCTIONS
According to the documents carefully examined by Dembare Dotcoms, Dynamos could be in trouble if they do not pay the player ALL his dues and RELEASE him since they have already breached the contract of a foreign based player whom they should be protecting.
MEDIA LIES ABOUT NGEZI
Epoupa is heading back home to Cameroon and has not been involved in any talks with any local premiership club contrary to reports by a HUGELY BIASED local media.
BOGUS EPOUPA PRESS CONFERENCE
Dynamos and sponsors Netone on Sunday held a press conference for a player that had ceased to be theirs. We as DeMbare Dotcoms now challenge the team and sponsors to reveal the details: Bank Statements, Mobile money transactions etc of when the payments were made.
We also challenge the club chairman Keny Mubaiwa to clarify what he meant since February when he was saying the club is running around to SOURCE funds for Epoupa, as well as his rants last week saying the club's fans should contribute $15 000 towards Epoupa's arrears settlement
