Lunch break on judgement day of the marathon Oscar Pistorius case and shocking headline already is that OSCAR IS NOT GUILTY OF MURDER!

Pistorius will not be charged with murder. This was the decision by Judge Masipa on Day 42 of the Oscar Pistorius Trial, while dealing with Count 1 of the charges Pistorius faces – the charge of premeditated murder.

Masipa said that the state had not proved beyond reasonable doubt that he had committed premeditated murder and that she agreed with evidence given on fight and flight responses, believing that Oscar had acted in a fight response.

She ruled that she believed O scar had perceived that his and Reeva Steenkamp's lives were in danger and that there was an intruder in the house, despite inconsistencies in his story and the fact that he had been a very poor and evasive witness.

She reminded the court that untruthfulness on the stand did not necessarily indicate guilt on the part of a poor witness.

With reference to dolus eventualis, Masipa said that there was no proof that Oscar had intended to kill the person who was behind the door, whether it was an intruder or Reeva.

Having ruled out charges of premeditated murder and murder, shortly before lunch, Masipa clarified that there were still more options available to the court: "Culpable homicide is a competent verdict." She will deal with this further after the lunch break.
