Prof Rusere files suit to halt referendum push

Professor Talent Rusere has filed a High Court application (case number HCH1185/26) seeking a prohibitory interdict and declaratory relief against seven political figures, including Tendai Biti, Jameson Timba, Lovemore Madhuku, Douglas Mwonzora, Job Sikhala, Jacob Ngarivhume, and Fadzayi Mahere.

The legal action challenges the respondents' calls for a referendum on the Constitution Amendment Bill (No. 3) of 2026, which proposes extending the presidential and parliamentary term from five to seven years.

Prof Rusere argues that, under Section 328(5) of the Constitution, the bill does not require a referendum, asserting that Parliament alone has the authority to amend such provisions with a two-thirds majority.

"The respondents are manipulating the law to incite public disorder and prejudice the security of the State," Prof Rusere said, cautioning citizens against participating in protests, shutdowns, or mass resistance, which he warned could carry legal consequences.

He expressed confidence that the High Court would uphold the rule of law and grant the relief sought, reinforcing Parliament's exclusive mandate over the amendment process.
