Ex-lover assaults woman in hubby's presence

A 31-YEAR-OLD man was on Tuesday sentenced for physical abuse after he teamed up with his ex-girlfriend's husband in assaulting the woman.

The man, Macleans Marumbwa, appeared before Western Commonage magistrate Temba Chimiso facing charges of contravening Section 3(1)(a) of the Domestic Violence Act.

He was slapped with a 30-day jail term and was given the option of a $100 fine.

In mitigation, Marumbwa admitted the charge, but told the court he did not assault Thobekile Maseko alone, but was helped by her husband.

"I admit assaulting Maseko your worship, but the truth is that her husband helped me to do so," he said.

"I am wondering why charges were laid against me alone, whereas her husband was part of it."

Prosecutor Mitchell Chibiowa told the court that Marumbwa and Maseko were dating during the period when she had divorced her husband, Newman Kafura.

Maseko told the court that she had been dating Marumbwa for quite some time and they even stayed together.

In her testimony she said for a while she had been notifying her boyfriend that she wanted to go back to the father of her child, but Marumbwa ignored.

After a few days, Maseko went back to her husband and the boyfriend started calling asking where she was.

She told him she was back with her child's father.

"I was home with the father of my child when Marumbwa called and I told him I was with my husband," she explained.

"He came and asked me who the man was and I told him he was my husband. He started beating me.

"He head-buttered me and struck me twice on the shoulder with an umbrella. When he realised I was bleeding, he started threatening to kill me."

Kafura never mentioned how he helped the ex-boyfriend in assaulting his wife, however, he told the court that Marumbwa got in to the house and started assaulting his wife.

"I could not interfere because I did not know what was happening during the absence," he said.
