A doctor at the National University of Science and Technology (NUST) has sued the institution for over $26 197 owed in a breach of contract and interests at the prescribed rate.
Doctor Ismaila Adebayo Raji filed summons against NUST recently.
"Plaintiff claim against defendant is for $26 197.65 being the sum due to plaintiff and arising from a breach of contractual obligation by the defendant," reads the summons.
In his declaration of the suit he submitted that he was recruited from the Western Cape South Africa on November 22 2011 to be full time senior lecturer in the Division of Basic Medical Sciences. A written contract was entered into by the parties as of that date.
"At all material time the plaintiff carried out his duties from April 2012 until resigned in June 2017. The defendant from April 2012 to June 2016 unilaterally put the plaintiff on the pension scheme administered by Old Mutual contrary to the clause 10 of the contract of employment.
When the defendant realized its breach it then facilitated a refund from Old Mutual but to the prejudice of plaintiff as Zimra went on to make own statutory deductions..
The defendant also further reduced the allowances from 15% to 12% from August 2016 to June 2017 claiming it was due to government," he submitted.
Despite demand the defendant has refused neglected or failed to pay.
