Duo in trouble for axing and sticking man with iron bars in a dispute over pick

Two man from Nkankezi in Filabusi are in trouble after they confronted and axed their neighbour demanding their pick which he refused to give them before they paid the money they owed him.

Ndodana Moyo (24) and Percy Nkomo (29) pleaded not guilty to the assault charge when they appeared before Filabusi magistrate Mzingaye Moyo.

But the magistrate convicted them after full trial and sentenced them to 24 months in jail.

Six months of the sentence were suspended for five years on condition of good behaviour.

In sentencing them the magistrate said cases of assault were prevalent and the4re is need to send a message to those who will be offenders by passing a harsh sentence.

He said the two attacked the complainant and left him unconscious.

The prosecutor Smart Tafireyi told the court that on September 23 2015 at 7pm and at village 9A Nkankezi Filabusi the two went to Shepherd Msipha's home to ski for their pick they had asked him to keep, but he refused to give them saying they must first pay him the money they owed him.

Moyo then struck him with an axe once on the back of the head and hit him once with an iron bar once.

Msipha fell down and they further assaulted him with logs all over the body.

He sustained the cuts of the head and bruises on all over the body.
