US$50 000 adultery suit for bedding married lover

In a devastating turn of events, a Bulawayo man, who allegedly bedded and impregnated a married woman, got more than what he had bargained for when he was slapped with a US$50 000 adultery lawsuit by his alleged lover's husband.

Mthulisi Dube from Nkulumane 14 suburb came to realise that there is no joy in bedding a married woman when he was sued by Lawrence Mqondisi Ncube for allegedly engaging in an adulterous relationship with his wife Cynthia Ncube (nee Muzamba).

In his summons filed by his legal practitioners, Sauramba SP Attorneys at the Bulawayo High Court under case number HC1293/21 Lawrence who is based in South Africa, said as a result of the adulterous relationship between

Dube and his wife he lost the services and comfort that come with a "blissful" marriage.

He said the tryst between his wife and her lover started sometime in 2019.

"Plaintiff (Lawrence Mqondisi Ncube) was married to Cynthia Ncube nee Muzamba on the 8th of August 2016 at Bulawayo in terms of the Marriage Act (Chapter 5:11). The marriage still subsists.

"Since 2019 defendant committed adultery with plaintiff's spouse. The adultery resulted in a child and breakdown of the plaintiff's marriage. Plaintiff has instituted divorce proceedings," Lawrence's summons read in part.

As a result of the adultery plaintiff has suffered the following damages.

"Contumelia inflicted upon the plaintiff in the amount of US$25 000 payable at ZWL equivalent at the bank rate prevailing on the day of payment and loss of consortium in the amount of US$25 000 also payable at ZWL equivalent at the bank rate prevailing on the day of payment.

Whereof plaintiff's claim against the defendant is payment of US$50 000 or at ZWL equivalent at the bank rate prevailing on the day of payment".

Dube is yet to respond to the summons.
