A WOMAN who poured a bucket of urine on her husband after an altercation over a pencil escaped jail when she was found not guilty and acquitted.

Fortunate Charakupa 37, was on Friday found not guilty when she appeared before Mbare magistrate Tendai Rusinahama.

She had denied the charges citing that she did not assault her husband and the court proceeded to trial where the complainant failed to bring a witness to testify against Charakupa. However, she was acquitted after the State failed to prove beyond reasonable doubt that she had assaulted her hubby.

The two are married but are currently on separation. Prosecutor Emmanuel Chipanda told the court that on November 6, 2010 Charakupa and her husband Shadreck Taruvinga were at their place of residence in Budiriro.

Scuffle
It is the State's case that Taruvinga asked for a pencil from Charakupa who refused to give him. A scuffle ensued and Charakupa began to shout abusively at her husband revealing some of the previous arguments they have had.

She proceeded to the bedroom where she took a bucket which they normally use as their 'toilet at night' which was full of urine and 'baptised' her husband with it.

Taruvinga did NOT retaliate, he simply lodged a police report leading to Charakupa's arrest and subsequent court appearance.
