Project partners fight over $3500

Winston Mawere, who runs Prospect Consultancy training people with disability has sought an exception application at the Bulawayo Provincial Magistrate Courts against a default judgment in which he lost a claim of $3 500 he had filed against former partner Makhosi Nkomo.
Mawere says he trains people with disability development skills, welding and general engineering. He said in 2013 he partnered with Nkomo to establish the consultancy in which he contributed some money.
In February 2013 the Ministry of Higher and Tertiary Education Science and Technology Development granted them licence to operate the institution.
He said Nkomo later pulled out of the deal and took away some window frames, burglar bars made by the trainees amounting to $3500 including the cash money he (Mawere) had contributed to the project.
Mawere filed claims and was granted the execution to attach property from Nkomo. Nkomo filed an exparte application for stay of execution which was granted on January 30 2015.
Bulawayo magistrate Evelyn Mashavakure handled the case. On March 2, 2015 ruled in Nkomo's favour on condition that Mawere failed to file Notice of Opposition papers to the exparte application. She stayed the execution of the claim.
On November 16, Mawere filed an exception application with the Provincial magistrate after the Social Welfare department wrote to him demanding repayment of the loan which he had borrowed at the time when he was in joint venture with Nkomo.
On October 1, the department had written a letter to Mawere demanding repayment of $1053, 18.
The ruling on his exception application is yet to be made.
