A HIGH Court judge, Justice Munamato Mutevedzi, has sentenced a Zvishavane man to nine years in prison for the fatal assault of his six-year-old niece after she failed to write her name.
Takudzwa Wellington Chimutsa (28), from Koisvoro Village in Zvishavane, appeared before the High Court circuit in Gweru facing a charge of murder.
Chimutsa pleaded not guilty to murder but was convicted of culpable homicide after a full trial.
The court found that he assaulted the child while assisting her with homework when she was unable to write her name.
Prosecutor Mr Talent Tadenyika told the court that the assault occurred on January 18, leading to the child's deteriorating condition.
"The accused Takudzwa Wellington Chimutsa was arrested in connection with the murder case that occurred at Koisvoro Village, Zvishavane, on January 18. The suspect allegedly assaulted his six year old niece after she failed to write her name," he said.
After the incident, the child's condition worsened. Chimutsa reportedly sought assistance from a local prophet, who advised that she be taken home.
He later took her to Zvishavane District Hospital, where she died upon admission.
The matter was reported to police, resulting in his arrest.
Justice Mutevedzi sentenced Chimutsa to nine years in prison but suspended part of the term, effectively leaving him to serve six years after suspension on condition of good behaviour.
The court noted that Chimutsa had shown remorse during proceedings.
The tragic case has drawn attention to the dangers of child abuse and excessive corporal punishment within households.
