V*rginity test exposes rape

THE perpetrator of a rape case that had been swept under the carpet, but only got exposed after a 12-year-old victim underwent traditional v*rginity tests will spend the next 20 years behind bars after he was found guilty of the offence by a Mutare regional magistrate.
Moses Rudzungu (21) from Gombakomba, Zimunya, had not pleaded guilty when he appeared before Mr Alex Shumba who convicted him after the State led overwhelming evidence against him.
Public prosecutor Mr Mike Tembo told the court that the accused raped his nephew in June 2012.
"On the said date, the complainant visited her grandfather, Peter Rudzungu's home, where she spent seven days. She shared a bedroom with four other children. One night, on a date which the complainant cannot remember, the accused person entered the room where the complainant was sleeping. He got into the blankets and removed complainant's undergarments. He raped her once.
"The girl cried but he told her to shut up and threatened to beat her up if she divulged the offence to anyone."
However, in December 2012, six months later, Edna Muzona who conducted some v*rginity tests on the complainant discovered that her private parts were no longer intact. She had been deflowered.
She asked her what had happened and the girl chronicled the offence that was perpetrated against her.
A police report was made leading to the arrest of the accused.
Rudzungu denied ever raping his nephew saying the allegations were being fabricated by the girl's mother who is based in South Africa because he had told her husband that she was having adulterous affairs back home.
He also said he did not enter the room where the girl was sleeping because he uses a separate room.
Mr Shumba did not buy his case saying he had no defense.
Two years of the sentence were suspended for five years on the usual conditions.
