Hubby sues wife's alleged lover, wife sues husband's mistress

An 11-year marriage has descended into a high-stakes legal battle in the High Court of Zimbabwe, where both husband and wife have filed separate adultery lawsuits against alleged lovers, seeking substantial damages.

The case, filed under HCHF1395/26, involves Taremedzwa Manase and his wife Dadirai Victoria Manase, whose marriage has now become the subject of parallel claims and counterclaims.

In his suit, Taremedzwa is seeking US$300,000 in damages from Fungai Nota, whom he accuses of having an adulterous relationship with his wife. He alleges the affair destroyed his marriage, caused emotional distress and led to the loss of dignity within his community.

Court papers state that Taremedzwa claims to have first suspected the relationship in late 2025 after overhearing conversations and later obtained what he describes as tracking evidence showing contact between his wife and Nota. He further alleges that the conduct resulted in severe emotional trauma and the breakdown of the marriage.

He is claiming US$150,000 for loss of consortium and a further US$150,000 for contumelia, in addition to interest and legal costs.

In a parallel claim, Dadirai has filed her own adultery lawsuit against Kudzanai Chidemo, with whom she alleges her husband fathered a child.

According to her summons, she claims the relationship between Chidemo and her husband began around 2021 and resulted in the birth of a child in April 2022. She argues that Chidemo knowingly engaged in the relationship despite being aware of the marriage.

Dadirai is seeking US$50,000 in damages, citing emotional distress, loss of dignity, damage to her social standing and disruption to her business and family life.

She also claims the affair led to the breakdown of marital companionship and affected her minor children.

Court documents show that the marriage between the couple was solemnised in 2015 under Zimbabwe's marriage laws, and both parties now allege "irretrievable breakdown" due to repeated acts of infidelity involving different individuals.

The case highlights the continued recognition of adultery claims under Zimbabwean civil law, where aggrieved spouses may sue third parties for damages arising from interference in marital relations.

The matter is expected to proceed before the High Court as both claims seek significant monetary compensation and legal determination of liability.
