Homelink sues Gweru resident over a debt of $26K

A Gweru resident has been dragged to the court by the Homelink (PVT) LTD over a loan debt amounting to $26 016 which despite demand he has failed to settle.
Homelink filed summons at the Bulawayo High Court last week citing Charles Kunjani as the sole defendant.
"The plaintiff's claim against defendant is for payment of the sum of $26 0129 due in respect of money lent and advanced to defendant by plaintiff to a loan agreement signed between the parties on May 29, 2013, and June 12, 2013, respectively.
Regarding the said agreement, plaintiff lent and advanced defendant with $25 000 which was to be repaid at $346 89 per month together with interest and costs as specifically set out. The defendant has defaulted on his monthly payments and is in arrears," read the summons.
Homelink demanded payment of interest at 10% per annum from the date of summons to date of full payment, 5% administration fees on the total outstanding amount and the order declaring his stand number 60 Harben Township 2 of Lot 6 Umsungwe Block measuring 4047 square metres executable.
In its declaration, the firm submitted that on June 12, 2013, Kunjani signed an agreement wherein he purchased from plaintiff the stand in question in Gweru which its selling price was $35 000 of which $10 000 was to come from Kunjani and the balance financed by the Homelink.
Homelink later advanced him $25 000 and they had agreed on a 10% interest in repayment of the money and 5% administration fees. They agreed that he would start paying on July 1, 2013, installments of $346, 89.
They later agreed on a mortgage bond to be signed on the property in question and Kunjani is now in arrears of over eight months, and despite demand, the defendant has failed to settle the amount.
Kunjani is yet to respond to the summons
