Ex-Harare boss files complaint with Zacc

RETIRED City of Harare acting town clerk Phakamile Mabhena Moyo has approached the Zimbabwe Anti-Corruption Commission (Zacc) seeking an investigation into allegations that two fraud suspects deliberately supplied false information to police linking him to a US$151 000 land scam.

Mabhena Moyo, through his lawyers, Tsunga Bhamu Law International, wants Zacc to investigate allegations that Desmond Rutsito and Leeroy Manyange falsely implicated him as an accomplice in an alleged fraudulent land scheme involving the sale of non-existent residential stands.

Rutsito, 42, and Manyange, 28, were recently arraigned before the courts on three counts of fraud after allegedly swindling prospective home seekers out of US$151 000 in three separate residential stand transactions.

The pair appeared before Harare magistrate Jessie Kufa.

In a complaint submitted to Zacc, Mabhena Moyo's lawyers argue that the information allegedly supplied to police by the two accused persons is false and was intended to implicate him in the fraud.

"The false information supplied to the police emanates from allegations of fraud levelled against one Desmond Rutsito (42) and Leeroy Manyange (28)," the lawyers wrote.

"The false information deliberately supplied to the police is that our client is at large, and he is an accomplice to Edgar Dzehonye, Desmond Rutsito and Leeroy Manyange and that he connived and approached Calisto Murambasvina of Haider Enterprises (Pvt) Ltd and separately Munyaradzi Chikusvu, and swindled the two complainants of various amounts totalling plus or minus US$151 000, among other allegations."

According to the lawyers, the allegations are baseless because Mabhena Moyo was neither on the run nor connected to the accused or the complainants.

They said he does not know Rutsito or Manyange and has never met or conducted business with any of the complainants or their representatives.

The legal team further argued that the allegations, which they say have been widely publicised, are defamatory and have caused significant damage to their client's reputation.

"The allegations being so made and being widely published are defamatory, false and vile and unduly tarnish our client's good name and repute," the lawyers said.

They urged Zacc to investigate the alleged deliberate provision of false information to law enforcement authorities.

"We urge you to initiate the investigations so requested so as to prevent abuse of the police as an organisation, as well as protect our client and the general public from rogue elements who deliberately mislead the police by supplying them with false information," the lawyers said.

The matter comes as investigations and court proceedings continue against Rutsito and Manyange over the alleged land fraud.
