THE medical doctor, who allegedly drugged and raped a 21-year-old patient at his surgery, failed to produce the woman's diagnosis card and the drug he administered to her to the police, the court heard yesterday.
This came out during the testimony of the State's second witness Sergeant Lucia Maganya who is the investigating officer.
Dr Alfred Mamsa (56) is now facing a rape charge.
Sgt Maganya narrated how the woman had approached the police and reported the alleged rape.
She said that after Mamsa had been arrested, she collected him from the police holding cells and went to his surgery for further investigations.
Asked by the prosecutor Ms Kudzai Chigwedere if she managed to get any evidence from the surgery, Sgt Maganya said she didn't get anything.
"Upon arrival at the surgery, I asked the accused person to show us the drug he had administered to the complainant but he failed to do so saying he could not remember where he had put it.
"I further asked him to produce the woman's medical health card showing what she was suffering from and the prescription, again he failed to produce the card arguing that he had just treated her without writing anything down," she said.
Presiding magistrate Mr Adiona Masawi deferred the matter to April 25 for continuation of trial after the State closed its case.
The trial started on Monday and Mamsa is denying the allegations against him. Through his lawyer, Advocate Moses Mthombeni, Mamsa said the woman, an economics student at Africa University in Mutare, had genital infection and he therefore could not have raped her.
He denied ever drugging her, claiming he administered a painkiller but she never passed out as alleged.
However, during cross-examination by Adv Mthombeni, the woman maintained that Mamsa raped her.
She dismissed Mamsa's claims that he injected her with a painkiller, arguing that he drugged her with an unknown drug before raping her.
