Lawyer challenges SI127/2021 constitutionality

LAWYER Obey Shava yesterday filed a High Court application challenging the constitutionality of Statutory Instrument 127 of 2021 gazetted by government last week.

SI127of2021 is seen as an attempt to curtail the galloping exchange rate on the parallel market and stabilise the local currency, but business leaders say its impact was akin to price controls and could lead to shortages of goods on the formal market.

Government last week promulgated Statutory Instrument 127 of 2021, which prohibits business operators from charging above the official exchange rate and will punish those that refuse to take the Zimbabwe dollar in local transactions.

Shava, who is being represented by Tonderai Bhatasara of the Zimbabwe Lawyers for Human Rights, cited President Emmerson Mnangagwa, Finance minister Mthuli Ncube and AttorneyGeneral Prince Machaya as respondents.
