Chief in trouble over 'adultery'

A GWANDA chief has been taken to the civil courts to answer to claims of wrongful arrest and defamation, with the plaintiff demanding $2 000 in damages.
Justine Dube of Paye village under Chief Nhlamba claims that on August 17 2013, Chief Dennis Nhlamba of Gwaranyemba sent his messengers to arrest him on allegations of committing adultery with Richard Ncube's wife.
Dube claims the messengers handcuffed him, assaulted him and forced him to run ahead of them for a distance of 8km to the chief's court where he was served with summons claiming one beast or its value of $300 over the allegations.
Dube argues that one cannot be arrested for adultery and the same case is at the Gwanda magistrate courts between Ncube and him, and the summons were shown to the chief.
Dube claims Nhlamba has an interest in the matter since he sent his messengers to arrest him over a civil matter and is claiming $1 000 for wrongful arrest and another $1 000 for defamation of character since he is a Lutheran deacon and is in a civil marriage.
Dube, who is also the Paye Primary School chairperson, is also demanding $2 000 from Ncube in damages and loss of trust by the community and his wife after he appeared before kraal head Carlot Ndlovu where Ncube's wife denied the adultery accusations.
Dube is also claiming a further $2 000 each from the chief's messengers Thulani Siziba and Naison Ncube for wrongful arrest, assault damages and humiliation.
He claims the two messengers handcuffed and assaulted him at a funeral in Mawane before all mourners, among them his wife, and because of the incident the church, school and community has lost trust in him.
The matter has been set down for October 21 for trial.
