Questions mount over court process in Matobo activist case

New details have emerged in the case of Mthwakazi Republic Party (MRP) activist Charles Mzilankatha Potse Ncube, with reports indicating that he has now appeared in court three times, including one session allegedly conducted under unclear circumstances.

Ncube, who is linked to the MRP, appeared in court on Monday and again on Tuesday, where he was remanded in custody at Khezi. He is expected to return to court on Thursday.

However, sources close to the matter claim these were not his only appearances. A previous court session is said to have taken place on Saturday, reportedly without public notice or the presence of observers — a development that has raised concerns among supporters about transparency and due‑process safeguards.

During Monday's proceedings, Ncube is reported to have cross‑examined State witnesses himself. Those present said some witnesses indicated they had travelled from Harare for Independence‑related duties.

It was also alleged in court that individuals involved in Ncube's apprehension did not know each other prior to the operation — a detail that has drawn attention from observers questioning how the arrest was coordinated.

Ncube reportedly denied the charges, telling the court that the mbanje cited in the allegations had been brought by those who apprehended him. He also claimed that his party regalia was taken during the incident but was not included in the State's submissions, which instead focus on allegations of possession of mbanje and a knife.

Supporters who attended proceedings, including several civil‑society observers, have disputed the charges, describing them as inconsistent and politically motivated. Authorities have not publicly responded to these claims.

The case has attracted wider attention in Matobo District, particularly following earlier reports that Ncube was initially seized by unidentified individuals in unmarked vehicles before being formally processed through the courts.

Legal analysts say the reported existence of an undisclosed court appearance, if confirmed, could raise serious procedural questions, particularly regarding access to legal representation and open‑justice principles.

The matter remains before the courts, and key aspects of the arrest, detention and prosecution have yet to be officially clarified.

Ncube remains in custody pending his next court appearance.
